In this proceeding brought pursuant to CPLR article 78, *738petitioners seek to annul the determination of their landlord, the New York City Housing Authority (NYCHA), which placed them on conditional probation based on their failure to timely remit rental payments. Petitioners challenge this determination on the ground, inter alia, that their failure to pay rent was predicated on the existence of serious and substantial unsanitary conditions which plagued their apartment for a sustained period of time.
