This is an appeal from a judgment rendered against the defendant by L. F. Putnam, Esq., as justice of the peace of the town of Otsego in this county, on the verdict of a jury, for $186 damages and costs. This action, based on alleged fraud, was brought by the plaintiff to recover on a check given to him by the defendant for the sum of $175. The defendant answered by general denial.
