Osie Goodgame, Jr. (Goodgame), who worked for Consol of Kentucky, Inc. (Con-sol) in both-Kentucky and Virginia, alleged that he suffered cumulative trauma injuries ' to his extremities and spine while employed by Consol. The ALJ dismissed Goodgame’s claim finding that he had not filed it within the applicable statute of limitations. The ALJ also found that Kentucky could not exercise extraterritorial jurisdiction' over any injuries that Good-game suffered while he was employed in Virginia.
