■ This is an appeal from a final order' of the Special Term of the Supreme . Court denying the appellant’s application for. a writ of peremptoi-y mandamus requiring the respondent, as clerk of the Municipal. Court of the city of New York, borough of Manhattan, ninth district, to issue a summons to the petitioner upon, the 'payment, of his legal fees therefor.
