Appeal from an order of the Supreme Court (McNamara, J.), entered November 19, 2012 in Albany County, which, among other things, denied defendants’ motion for summary judgment dismissing the complaint.
At approximately 4:00 p.m. on the afternoon of May 17, 2010, plaintiff was traveling westbound on the shoulder of State Route *121520 in the Town of Guilderland, Albany County in his motorized wheelchair.
