Defendant appeals from a conviction of second-degree murder resulting in a State Prison sentence of 25 to 30 years.

On the early morning of February 24, 1955 the defendant shot his wife Antoinette while she was standing next to the driver’s side of a parked car in front of a tavern at 145 Third Street, Passaic, Hew Jersey. He was seated behind the wheel of his own car, about 18 feet away, on the opposite side of the street.
