Petitioner was convicted of murder in the perpetration of robbery and, in accordance with the verdict, was sentenced to death. Thereafter petitioner prosecuted a timely appeal to this court, as a result of which the judgment was affirmed and a petition for rehearing was denied. Brown v. State (1958), 239 Ind. 184, 154 N. E. 2d 720.
Thereafter petitioner filed a petition for writ, of certiorari to the United States Supreme Court, which was denied. Later, petitioner petitioned for a writ of habeas corpus to the United States District Court for the Northern District of Indiana. The latter was…
