—Appellee brought this suit to recover damages for personal injuries alleged to have been caused by the negligence of the appellant. Plaintiff’s petition contained two counts. In the first count it is alleged in substance that on April 27, 1901, the plaintiff and three coservants were employed by the defendant as section hands on its line of road in Harris County, near the city of Houston, and while engaged in the discharge of their duties, and while under the control of defendant’s foreman, who is alleged to be the vice-principal of the defendant at that time,…
