Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered August 16, 1996, upon a verdict convicting defendant of the crime of murder in the second degree.
On August 15, 1994, the badly decomposed body of Willie Price was discovered in his basement apartment at 47 Second Street in the City of Albany. Following a jury trial, defendant was acquitted of intentional murder in the second degree and convicted of depraved indifference murder in the second degree, and sentenced to a prison term of 25 years to life.
