In a coram nobis proceeding, defendant appeals from an order of the County Court, Suffolk County, dated February 8, 1963, which denied without a hearing his application to vacate a judgment of said court rendered June 5, 1957 after a jury trial, convicting him of robbery in the first degree and imposing sentence. The judgment of conviction was previously affirmed by this court (14 A D 2d 900, mot. for lv. to app. den., Desmond, Ch. J., March 7, 1962 — the conviction being there erroneously referred to as one of burglary in the first degree). Order affirmed. We shall assume that, under…
