This appeal is from a judgment in an action in favor of the respondent against the appellant, for a personal injury alleged to have been sustained in consequence of a defective walk across one of the appellant’s streets. The respondent alleged in her complaint that the appellant was a municipal corporation, having exclusive power and authority to provide for the construction, cleaning, and repair of side and cross-walks in said city ; that it undertook to and did construct and maintain a cross-walk on the south side of Marion street, and across Winter street therein, which streets were at the…
