TYSON, Judge.

Douglas M. Robins (“plaintiff’) appeals from the trial court’s order granting summary judgment in favor of the Town of Hillsborough (“defendant”). We reverse and remand.

I. Background

On 21 January 2003, plaintiff filed an application for site plan approval with defendant to construct an asphalt plant within the town limits of Hillsborough. Georgia-Pacific Corporation owned the property on which the facility was to be constructed.
