Appeal from a judgment of the superior court for King county, Dykeman, J., entered July 3, 1915, upon findings in favor of the defendant, in an action on contract, tried to the court.

The appellant instituted this action against the defendant, Katie Jamieson, and the respondent, Mrs. T. A. Babcock, to recover upon a written contract for the erection of a tombstone. His complaint, omitting the formal parts, was as follows:

“Comes now the plaintiff herein, and for his cause of action against the said defendants, states and alleges:
