HODGES, Associate Justice.

On the 12th day of November, 1907, the appellant instituted this suit in the Justice Court of precinct Ko. 1 of Bed River County against the appellee for damages for the conversion of 55 trees valued at $165. The case was tried on the 30th of December following, resulting in a judgment in favor of the defendant in the suit. The appellant, plaintiff below, appealed to the County Court.
