White, applied to purchase the section of school land in controversy as an actual settler, October 26, 1899, complying in all respects with the law providing for the sale of such lands, but his application was rejected by the Land Commissioner because of the previous award, on September 25, 1899, to appellant Watson, upon his application filed in the General Land Office, July 24, 1899, to purchase it as additional land to the quarter section of school land which the evidence tended to show was then occupied by him as a home, and had been since he…
