In the spring of 1935 plaintiff Thompson entered into a contract with the defendant oil company to become its bulk station agent and manager of its retail service station in the town of Isabel, South Dakota. Plaintiff was to furnish a truck for the delivery of gas and oil and the defendant a suitable tank and rack for such purpose. Under the contract the plaintiff was to sell the defendant oil company’s merchandise at a commission and was to pay $30 per month to the defendant as rent on the service station.
