This case was tried by the court without the intervention of a jury in Natrona County upon issues duly joined. The court rendered judgment in favor of the defendant and dismissed the plaintiff’s petition on May 4th, 1923, but the judgment was not entered of record until May 8th, 1923. A motion for a new trial was filed on May 17, 1923. This motion was sustained on December 22nd, 1924, Judge R. R. Rose presiding. The case being about to be set down again for trial, the defendants filed a motion on August 11, 1928, to vacate the order entered by Judge Rose on December 22nd,…
