The leading question involved in these cases, and the one conclusive of the result if decided in the affirmative, is, whether the bonds issued by the county of Lauderdale in aid of the Mississippi River Railroad *154Company are valid or void. If valid, then the other questions which have been argued before us are unnecessary to be considered. We therefore dispose of this question first.

The bonds of the county in contest were issued in pursuance of two acts of the Legislature — one passed ^February 25, 1867, the other November 5, 1867. By section 6 of the first act, it was provided that the county…
