Bruce Roberts sued E. J. Brown, sheriff of Clay County, and his bondsmen to recover damages for false imprisonment, alleging that said Brown made a complaint before a justice of the peace of precinct number 1 in Clay County, charging him with the offense of assault with intent to murder in the Indian Territory on the-day of-, 190—; that the justice of the peace issued a warrant for plaintiff’s arrest upon which plaintiff was arrested by the defendant Brown and placed in the county jail, where he was kept confined. for a period of about forty hours with no opportunity…
