Remaining before the Court in this Adversary Proceeding are counterclaims by Tali Tomsic (“Trustee” or “Plaintiff’), as Chapter 7 trustee in bankruptcy of TriStar Technologies Company, Incorporated (the “Debtor”) against Anthony F. Lauti-eri, Sr. (“Lautieri, Sr.”), Accelerated Technologies, Inc. (“Accelerated”) and Anthony F. Lautieri, Jr. (“Lautieri, Jr.”) (collectively the “Defendants”).
