This is an action brought by plaintiff to recover the value of a quantity of sand supplied by her assignor, Frederick Williams, to the defendant Daiker, and used by bim in the construction of three houses at St. Bichólas avenue and One *71Hundred and Forty-fifth street, in the borough ef Manhattan, city of Hew York; one on the comer and two adjoining on said street.
