MEMORANDUM OPINION

HULL, Senior District Judge.

This is a consolidation of class actions on behalf of those who purchased securities of King Pharmaceuticals on the open market between February 16, 2000, and March 10, 2003, and on behalf of those who acquired their shares through the merger of Jones Pharmaceutical with King Pharmaceuticals.

Two groups of plaintiffs have filed motions to remand their class actions to state court. The motions have been filed by Jeanne Morton, Frank J. Siano, Philip Frank LoPiccolo, Kevin S. Fitzpatrick, Andrew Medley, Walter E. McNeil and George W. Phillips, Jr.…
