Affirming.

The appellant was convicted of the crime of murder and sentenced to death. He appeals.

The facts are these: Appellant,- who lived in Cynthiana, had been arrested for a violation of the federal prohibition laws and carried to Lexington for trial before the federal court sitting at that place. He gave bond and returned to Cynthiana.
