Appeal from Circuit Court, Jefferson County. Bills by H. H. Crumlish’s administrator against the Shenandoah Valley Railroad Company and the Fidelity Insurance,Trust & Safe-Deposit Company against the same defendant. From a decree settling the accounts of one McDonald, receiver of an intervening creditor, he appeals.

It seems useless to write an opinion in this case, as it involves only the construction of a contract, and no legal principles of guidance to the public. But it is customary. The Shenandoah Valley Railroad was under a decree of sale for its indebtedness. A part of such indebtedness *568was a recovery in the name of McDonald, receiver of the Central Improvement' Company, against the Shenandoah Valley Railroad Company, amounting, February 10, 1891, to seven hundred and ninety-one thousand three hundred and thirty-eight dollars and nine cents ; but that was subject to a prior…
