Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for performance of duty disability retirement benefits.
Petitioner, a police detective, underwent a cardiac stent procedure in January 2003 and thereafter returned to work. While conducting a crime scene investigation eight months later, petitioner displayed symptoms of a cardiac event and was transported to a local hospital for evaluation.
