*1034Appeal from an order of the Supreme Court, Oneida County (Hugh A. Gilbert, J.), entered October 3, 2005. The order directed respondent Commissioners of the Oneida County Board of Elections to remove from the November 8, 2005 general election ballot a proposition submitted by the 2005 Charter Revision Commission of the City of Utica.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs and the petition is dismissed.
