The matter of which this is an adjunct proceeding came before us on a writ of habeas corpus brought by one Isaac W. R. Burno, in Common Pleas Court No. 3, March term, 1964, no. 860.

During the hearing on defendant Burno’s writ, the Commonwealth sought to prove that at Mr. Burno’s original trial before the Hon. Vincent A. Carroll, defendant Burno refused the voluntary defender as counsel.
