ORDER ON MOTION FOR PARTIAL SUMMARY JUDGMENT

THIS MATTER is before the court on the motion for partial summary judgment on counts I and II of the counterclaim filed by David F. Brown, Robert F. Ehrling, Tore T. DeBella, Richard Reizen, and Reuben O’D. Askew (collectively “the Insureds”). 1 The Insureds, in substance, request the Court to require National Union to continue funding the defense of certain civil and criminal actions on a current basis under the terms of a directors and officers liability policy.
