On February 26, 2008, United States Magistrate Judge Paul J. Cleary entered a Report and Recommendation (Dkt. # 204) on plaintiffs’ attorney fee request of $137,770.50. The magistrate judge recommended that plaintiffs, as the prevailing parties, receive a fee award of $36,650.00. The parties filed timely objections (Dkt. ## 205, 206). Pursuant to 28 U.S.C. § 636(b) and Fed.R.Civ.P. 72(b), plaintiffs filed a timely response (Dkt. #207) to defendant’s objection.
