In the Fall of 1910, Walter E. Mueller was employed by F. Mertens Sons as an arboriculturist in connection with an orchard which" they were developing in Allegany county. He discharged the duties of that position from the first' of September until about December 20th. As a part of "his duties he supervised the setting out of the young trees and the pruning of them, in which process there were cut from the trees a large number of scions or buds.
