Appeal from a judgment of the Ontario County Court (Frederick G. Reed, J.), rendered September 21, 2006. The judgment convicted defendant, upon a jury verdict, of criminal possession of a controlled substance in the third degree, criminal posses*1327sion of a weapon in the third degree and endangering the welfare of a child (two counts).

It is hereby ordered that the judgment so appealed from is unanimously modified on the law by vacating the forfeiture of $1,685 and by vacating the sentence and as modified the judgment is affirmed, and the matter is remitted to Ontario County Court for…
