LINDLEY, Circuit Judge.

This is an action under the Federal Employer’s Liability Act, 45 U.S.C.A. § 51 et seq., to recover damages for personal injuries sustained by plaintiff in the course of his employment as a brakeman by defendant, resulting, as he averred, from the negligence of defendant in failing to provide him with a reasonably safe place in which to work. Defendant’s motions for a directed verdict made at the close of plaintiff’s evidence and at the close of all the evidence were denied, as was its alternative motion for a new trial.
