The defendant tea company had been operating a retail store in the city of Gladstone for several years prior to March 6, 1929. Armand LaPointe, hereafter called the plaintiff, had been employed for some time prior thereto in delivering merchandise and “peddling bills” by a former manager, Lawrence Gross, and its then manager, the defendant Chevrette.
