HOLMES, Circuit Judge.
This appeal is from an order dismissing appellant’s writ of habeas corpus, wherein he sought to be discharged from the custody of the District Director of Immigration and Naturalization in Miami, Florida.
Appellant is a native of Sweden. He first came to the United States in 1920, and was legally admitted as a resident of New York. In 1932, he was convicted of the crime of petit theft in California.
