The opinion of the court, read at this term, was prepared, at the last term by

Slidell, J.

P. H. Robert and B. C. Robert were associated in a commercial partnership in the parish of St. Mary, under the firm of P. H. & B. C. Robert. The interest of the former was two thirds, and that of the latter one-third. In 1838 the firm was dissolved by mutual consent, and B. C. Robert was charged with the liquidation of its affairs.
