HAMITER, Justice.

Irvin Mattio is appealing from his conviction and sentence for the murder of Sylvian Paul Cassagne on May 3, 1945.

The indicting of him by the Orleans Parish Grand Jury occurred May 10, 1945. When arraigned four days later he pleaded not guilty.

On July 23, 1945, appellant, through his attorney, obtained an order of court requiring the Superintendent of the New Orleans Police Department and the District Attorney of Orleans Parish to show cause why his attorney should not be permitted to see, read, and, if thought advisable, make a copy of the police report, then in the…
