ERROR to review a judgment of the circuit court for Keno-sha county: E. E. BELDEír, Circuit Judge.

Franlc 3. Komp was prosecuted and convicted of the crime of perjury, and brings his writ of error to reverse the judgment.

It appeared on the trial that in the month of October, 1902, Komp organized an incorporated trust company at Kenosha, Wisconsin, with a nominal capital stock of $50,000, and became president of the company; that on or about October 30, 1902, an affidavit was prepared by Mr. Peter Eisher, a lawyer and notary public residing at Kenosha, as required by the terms of sec. 1J91A; Stats. 1898, stating that fifty per cent, of the capital stock of said corporation had been paid in…
