Defendant appealed. Error assigned, among others, was in refusing defendant’s motion for binding instructions, for a new trial and in arrest of judgment.

Mr. Justice Stewart,. The prisoner stands convicted of murder of the first, degree. It is for us to inquire whether or not the in*157gredients necessary, to constitute murder of the-first, degree have been proved to exist. The dead body of; Lillian W; Selladle, a young girl twelve-and-a-half years of age was found on the evening of 28th November, 1912, in a reservoir a short distance aside from the thoroughfare leading from East Pittsburgh to Willtinsburg, in Allegheny County. The last time this girl had been seen alive was the evening of the day previous. The autopsy disclosed nothing…
