{¶ 1} Defendant-appellant, Daniel Roth, appeals from a Judgment Entry-Decree of Divorce filed by the Cuyahoga County Court of Common Pleas, Domestic Relations Division, on November 14, 2006. For the reasons that follow, we reverse the judgment of the trial court.

{¶ 2} Appellant and plaintiff-appellee, Enza Roth, were married on February 14, 1984. Two children were born during the marriage. On July 16, 2004, Enza Roth filed an action for divorce. Appellant answered and filed a counterclaim for divorce on July 22, 2004. At the time of the action, the parties had been married more than 20 years.…
