MARTIN, Justice.

Appellee Cal Shepherd filed suit in the district court of Gray county, Tex., against Lon Blanseet, sheriff of said county, and the Agricultural Bond & Credit Corporation of Chicago, for the unlawful conversion of 717 bushels of wheat “of the reasonable market value of $400.00.” He sued further for exemplary damages in the sum of $1,000, alleging “that all of the acts in converting said wheat were willful and malicious and gross negligence on the part of said defendants and each of them.”
