OPINION and ORDER
NORGLE, District Judge.
Before the court is Defendants’ motion to dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6). For the following reasons, the motion is granted.
I. BACKGROUND 1
Plaintiff Thomas Pollastrini (“Pollastrini”) was a career union patternmaker. In early 1962, he attended a union meeting in Oakland, California along with “all of the other union members from the Bay area which also included retiress [sic ].” (Compl.t 8.)
