Appeal from an order of the Court of Claims (Lyons, J.), entered June 29, 1987, which denied the State’s motion for summary judgment dismissing the claim.
Claimant, an infant, seeks to recover damages against the State for serious personal injuries sustained on December 17, 1984 when the automobile in which he was a passenger overturned on State Route 22 in the Town of Austerlitz, Columbia County, while being pursued by State Trooper C.
