Statement of the Case.

MONROE, C. J.

This is an action in jactitation of title wherein there was a judgment for plaintiff, from which defendant has appealed.

The issues were made up by the allegations of the petition and those of the following exceptions, which were filed by defendant and allowed to stand as an answer, to wit:(1) “That plaintiff’s petition discloses no cause of action, in that it alleges that the possession of the surface rff the land is in another, to wit, one A. Bolden, and the plaintiff cannot maintain a slander of title action without alleging and proving that the plaintiff…
