Appeal from a judgment of the County Court of Clinton County (Lewis, J.), rendered August 1, 1994, convicting defendant upon his plea of guilty of the crime of manslaughter in the second degree.

On August 28, 1993 at approximately 7:45 a.m. Mark Smith, an inmate at Clinton Correctional Facility in Clinton County (hereinafter the facility), was stabbed to death. Defendant, also an inmate at the facility, was indicted for the crimes of murder in the first degree and promoting prison contraband in the first degree.
