Reversing.

C. M. Rowland instituted suit in tbe Nelson Circuit Court against Dr. A. M. Shields, in which he sought to recover damages for assault and battery. The case was transferred to the Spencer Circuit Court, where, upon a trial before a jury, the plaintiff recovered a verdict for $750. Judgment was entered upon the verdict, and the motion and grounds for new trial was overruled.
