Appellant, Lee Eeed, was convicted of the crime of manslaughter and’his punishment fixed at confinement in the penitentiary for a term of three years. From the judgment of conviction he appeals. .

The facts appearing from the record are as follows: Appellant, together with Bill McCullom, John D. Baker, Bob Baker and another party were together a greater portion of the day of March 18th, 1910.
