On the 6th day of .-April, 1900, the defendant was the owner of a farm in Orleans county, which he had purchased at a foreclosure sale. The plaintiff’s assignor, John Stockham, was in possession of the same as tenant; The défendant desired to commence farming on the premises and Stockham was desirous of purchasing the same, and with these objects in. view they entered into an agreement for the purchase of said farm by Stockham at- his option by complying *101with the terms of the agreement.
