Appeal from a judgment of the Supreme Court (Ferradino, J.), entered May 2, 2005 in Saratoga County, which granted defendants’ motion to dismiss the complaint.

Plaintiff is a teacher at defendant Schuylerville Central School District. In May 2002, she sought and obtained permission from defendant Thomas S.
