MARSHALL, Circuit Justice.

William Brown, a citizen of Virginia, and Boyd Miller, a British subject, entered into partnership, and carried on trade and commerce, by the name of “William Brown & Co.” During the partnership, William Brown purchased a house and lot in Lynchburg, with the funds and for the benefit of the company, but took the conveyance to himself. Some time in the year 1811, William Brown departed this life, having first made his last will in writing, which was properly recorded in February, 1812; by which, after certain legacies, his estate was devised to his relations in…
