Third-party defendant-appellant Security Pacific International Bank (“Security Pacific”) appeals from a judgment, entered in the United States District Court for the Southern District of New York (Robert P. Patterson, Jr., Judge), granting plaintiffappellee Banque Worms’ motion for summary judgment. On this appeal, Security Pacific contends that the district court erred by applying the Discharge for Value Rule, set forth at Section 14 of the Restatement of the Law of Restitution (1937).
